Domestic Violence Orders (National Recognition) Regulations 2017

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Domestic Violence Orders (National Recognition) Act 2016 .

1.   Short title

These regulations may be cited as the Domestic Violence Orders (National Recognition) Regulations 2017 .

2.   Commencement

These regulations take effect on the day on which the Domestic Violence Orders (National Recognition) Act 2016 commences.

3.   Principal Act

In these regulations, the Domestic Violence Orders (National Recognition) Act 2016 is referred to as the Principal Act.

4.    Section 6 amended (Interstate DVO)

Section 6(1) of the Principal Act is amended as follows:
(a) by inserting the following paragraph after paragraph (a) :
(ab) a family violence order under the Family Violence Act 2016 of the Australian Capital Territory;
(b) by omitting paragraph (d) and substituting the following paragraph:
(d) a domestic violence order, police protection notice or release conditions under the Domestic and Family Violence Protection Act 2012 of Queensland;
(c) by omitting subparagraph (ii) from paragraph (g) and substituting the following subparagraph:
(ii) a family violence restraining order;

5.    Section 7 amended (Registered foreign order)

Section 7(1) of the Principal Act is amended as follows:
(a) by omitting paragraph (a) and substituting the following paragraph:
(a) a registered foreign order under the Family Violence Act 2016 of the Australian Capital Territory; or
(b) by omitting paragraphs (d) and (e) and substituting the following paragraphs:
(d) a registered New Zealand order under the Domestic and Family Violence Protection Act 2012 of Queensland; or
(e) a foreign intervention order registered under Part 4 of the Intervention Orders (Prevention of Abuse) Act 2009 of South Australia, other than an order that is declared by the regulations made under that Act not to be a foreign intervention order for the purposes of Part 3A of that Act; or

Displayed and numbered in accordance with the Rules Publication Act 1953.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) for the purposes of section 6(2) of that Act, amend the list of interstate DVOs specified in subsection (1) of that section, by omitting certain orders from that list and adding certain new orders to that list; and
(b) for the purposes of section 7(2) of that Act, amend the list of registered foreign orders specified in subsection (1) of that section, by omitting certain foreign orders from that list and adding certain new foreign orders to that list.
