State Service (Consequential and Miscellaneous Amendments) Act 2000
An Act to amend certain Acts and statutory rules consequential on the enactment of the State Service Act 2000
[Royal Assent 20 December 2000]
Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
This Act may be cited as the State Service (Consequential and Miscellaneous Amendments) Act 2000 .
This Act commences on the day on which the State Service Act 2000 commences.
The Acts specified in Schedule 1 are amended as specified in that Schedule.
The Statutory Rules specified in Schedule 2 are amended as specified in that Schedule.
5. Botanical Gardens By-laws 1997 amended
Clause 3 of the Botanical Gardens By-laws 1997 is amended by omitting the definition of "Director of Gardens" and substituting the following definition:Director of Gardens means the person appointed under the State Service Act 2000 to be the Director of Gardens;
6. Building Appeals Regulations 1984 amended
Regulation 7 of the Building Appeals Regulations 1984 is amended by omitting " Tasmanian State Service Act 1984 , in respect of whom Part II of the Tasmanian State Service Regulations 1984 applies" and substituting " State Service Act 2000 ".
7. Electoral Regulations 1985 amended
Regulation 46(3) of the Electoral Regulations 1985 is amended as follows:(a) by omitting paragraph (b) and substituting the following paragraph:(b) on a weekday that is a holiday appointed pursuant to section 53 of the State Service Act 2000 ;(b) by omitting paragraph (d) and substituting the following paragraph:(d) on the part of a weekday that is a part holiday appointed pursuant to section 53 of the State Service Act 2000 .
8. Environment Protection (Remuneration and Allowances) Regulations 1985 amended
(1) Regulation 3(1) of the Environment Protection (Remuneration and Allowances) Regulations 1985 is amended as follows:(a) by omitting from paragraph (b) " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ";(b) by omitting from paragraph (c) " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".(2) Regulation 4 of the Environment Protection (Remuneration and Allowances) Regulations 1985 is amended by omitting "to whom the Tasmanian State Service Act 1984 applies" and substituting "who is a State Service officer or State Service employee".
9. Evidence (Commissioners for Declarations) Regulations 1988 amended
Regulation 4 of the Evidence (Commissioners for Declarations) Regulations 1988 is amended by omitting from subregulation (1) "employees, within the meaning of the Tasmanian State Service Act 1984 ," and substituting "State Service officers and State Service employees".
10. Land Use Planning and Approvals Regulations 1993 amended
Regulation 4 of the Land Use Planning and Approvals Regulations 1993 is amended by omitting paragraph (a) and substituting the following paragraph:(a) an Agency within the meaning of the State Service Act 2000 ;
11. Police Regulations 1974 amended
Regulation 2 of the Police Regulations 1974 is amended by omitting from subregulation (2) "section 75 of the Tasmanian State Service Act 1984, as a holiday or half-holiday" and substituting "section 53 of the State Service Act 2000, as a holiday or part holiday".
SCHEDULE 1 - Consequential AmendmentsAboriginal Lands Act 1995
1. Section 20(3) is amended by omitting " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".Aboriginal Relics Act 1975
1. Section 4(9) is amended by omitting " Tasmanian State Service Act 1984 , but an employee, within the meaning of that Act, may hold office as a member of the Council in conjunction with his position in the State Service" and substituting " State Service Act 2000 , but a State Service officer or State Service employee may hold office as a member of the Council in conjunction with State Service employment".
2. Section 15 is amended as follows:Acts Interpretation Act 1931(a) by inserting in subsection (1) "State Service officers or State Service" after "appoint";(b) by omitting subsection (1A) and substituting the following subsection:(1A) The Secretary of the Department, with the consent of another Head of a State Service Agency, may appoint State Service officers and State Service employees employed in that Agency to be wardens for the purposes of this Act, and such officers and employees may hold office as wardens in conjunction with State Service employment.
1. Section 20(b) is amended by omitting "or position as such, by the holder for the time being of such office or position" and substituting ", position or appointment as such, by the holder for the time being of such office, position or appointment".
2. 1. Section 3 is amended as follows:Agricultural and Veterinary Chemicals (Control of Use) Act 1995(a) by omitting " section 6 or 24 of the Tasmanian State Service Act 1984 " from the definition of administrative instrument and substituting " section 11, 12 or 13 of the State Service Act 2000 ";(b) by omitting " Tasmanian State Service Act 1984 " from paragraph (a) of the definition of department and substituting " State Service Act 2000 ";(c) by omitting " Tasmanian State Service Act 1984 " from the definition of State authority and substituting " State Service Act 2000 ".
1. Section 17(2) is amended by omitting "his or her position or office under the Tasmanian State Service Act 1984 " and substituting "State Service employment".
2. Section 26(3)(b) is amended by omitting "employees, within the meaning of the Tasmanian State Service Act 1984 ," and substituting "State Service officers and State Service employees".
3. 2. Section 15(2A) is amended by omitting "the Head of another Agency, within the meaning of the Tasmanian State Service Act 1984 " and substituting "another Head of a State Service Agency".
3. 1. Section 6 is amended by omitting "his or her position or office under the Tasmanian State Service Act 1984 " and substituting "State Service employment".
2. Section 7(1) is amended by omitting "his or her position or office under the Tasmanian State Service Act 1984 " and substituting "State Service employment".
3. Section 8 is amended as follows:Anti-Discrimination Act 1998(a) by omitting from subsection (1)(b) "the Head of another Agency, within the meaning of the Tasmanian State Service Act 1984 , persons" and substituting "another Head of a State Service Agency, State Service officers and State Service employees";(b) by omitting from subsection (1)(c) "employees within the meaning of that Act" and substituting "State Service officers or State Service employees";(c) by omitting subsection (7) and substituting the following subsection:(7) A State Service officer or State Service employee may hold the office of inspector in conjunction with State Service employment.

3. Section 89 is amended as follows:Anzac Day Observance Act 1929(a) by omitting subsection (2) and substituting the following subsection:(2) If the Tribunal finds after an inquiry that a complaint against a State Service officer or State Service employee is substantiated, it may order the Minister responsible for the Agency in which that officer or employee is employed to exercise any one or more of the powers specified in section 10 of the State Service Act 2000 .(b) by omitting from subsection (3) "an inquiry under section 55 of the Tasmanian State Service Act 1984 " and substituting "a determination arising from an investigation under section 10 of the State Service Act 2000 ".

1. Section 4A(1) is amended by omitting " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".Building and Construction Industry Training Fund Act 1990
1. Section 13 is amended as follows:(a) by omitting subsection (3) and substituting the following subsection:(3) A State Service officer or State Service employee may hold office as administrator of the Board in conjunction with State Service employment.(b) by omitting from subsection (10) "an employee, within the meaning of the Tasmanian State Service Act 1984 ," and substituting "a State Service officer or State Service employee";(c) by omitting from subsection (10) "Commissioner for Public Employment" and substituting "State Service Commissioner".
2. Section 14(2) is amended by omitting "an employee, within the meaning of the Tasmanian State Service Act 1984 , or a person appointed under Part V of that Act " and substituting "a State Service officer or State Service employee".
3. Section 19(2) is amended by omitting " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".
4. Clause 4 of Schedule 4 is amended by omitting " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".Children, Young Persons and Their Families Act 1997
1. Section 3(1) is amended as follows:(a) by omitting the definition of employee of the Department and substituting the following definition:employee of the Department means a State Service officer or State Service employee employed in the Department;(b) by omitting " Tasmanian State Service Act 1984 " from paragraph (a) of the definition of Government Agency and substituting " State Service Act 2000 ".
2. Section 78 is amended by inserting after subsection (1) the following subsection:(1A) The Commissioner may hold the office of Commissioner in conjunction with State Service employment.
3. Section 86(2) is amended by omitting "an employee, within the meaning of the Tasmanian State Service Act 1984 ," and substituting "a State Service officer or State Service employee".
4. Schedule 1 is amended as follows:(a) by omitting subclause (2) from clause 3 ;(b) by omitting from clause 4 " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".
5. Clause 5(4) of Schedule 2 is amended by omitting " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".
6. Part 2 of Schedule 3 is amended as follows:Chiropractors and Osteopaths Registration Act 1997(a) by omitting from clause 4(2) "a position or office held under the Tasmanian State Service Act 1984 " and substituting "State Service employment";(b) by omitting from clause 5 " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".
1. Section 11(5) is amended as follows:(a) by omitting "an employee or a person holding or acting in an office under the Tasmanian State Service Act 1984 , or in an Agency within the meaning of that Act," and substituting "a State Service officer or State Service employee";(b) by omitting "that Act" second occurring and substituting "the State Service Act 2000 ".

Section 10 is repealed and the following section is substituted:(1) Subject to and in accordance with the State Service Act 2000 , persons may be appointed or employed to assist the Commission in the performance of its functions or the exercise of its powers.(2) The Secretary of the Department, at the request of the Commission, may provide it with State Service officers and State Service employees employed in the Department.

1. Schedule 1 is amended by omitting paragraph (b) from clause 2(1) of Part 1 and substituting:Retirement Benefits Regulations 1994(b) a State Service officer or State Service employee; or

Regulation 3(1) is amended as follows:(a) by omitting "an" from paragraph (a) of the definition of Agency and substituting "a State authority or other";(b) by inserting "appointed or" after "person" in the definition of eligible employee ;(c) by omitting " regulation 49 " from the definition of eligible employee's account and substituting "the accumulation scheme";(d) by inserting "appointed or" after "means a person" in the definition of employee ;(e) by omitting " section 24 " from the definition of Government department and substituting "section 11";(f) by omitting the definition of Head of Agency and substituting the following definition:Head of Agency has the same meaning as in the State Service Act;(g) by omitting "to a position in the State Service under section 36 or 38(1)(b) " from paragraph (a) of the definition of permanent employee and substituting "as a permanent employee under section 37";(h) by omitting " section 38 " from paragraph (e) of the definition of permanent employee and substituting "section 37";(i) by omitting " Part V " from paragraph (h) of the definition of permanent employee and substituting "Part 6";(j) by omitting "elects, under section 29(12) of that Act, to continue to be an employee for the purposes of these regulations" from paragraph (h) of the definition of permanent employee and substituting ", immediately before his or her appointment, was a contributor to the contributory scheme";(k) by inserting the following subparagraph after subparagraph (ii) in paragraph (n) of the definition of permanent employee :(iia) who is appointed for a specified term or for the duration of a specified task under section 37 of the State Service Act; or(l) by omitting subparagraph (vii) from paragraph (n) of the definition of permanent employee ;(m) by omitting " Tasmanian State Service Act 1984 " from the definition of State Service Act and substituting " State Service Act 2000 ".
2. Regulation 7(3) is amended as follows:(a) by omitting "person holding a position or an office under the State Service Act" and substituting "State Service officer or State Service employee";(b) by omitting "a position or an office under the State Service Act" second occurring and substituting "State Service employment".
3. Regulation 96 is amended as follows:Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000(a) by omitting from subregulation (5)(a) "Commissioner for Public Employment" and substituting "State Service Commissioner";(b) by omitting from subregulation (5)(a) "employed in an office or position that is subject to the State Service Act" and substituting "a State Service officer or State Service employee";(c) by omitting from subregulation (6)(a) "Commissioner for Public Employment" and substituting "State Service Commissioner";(d) by omitting from subregulation (6)(a) "employed in an office or a position that is subject to the State Service Act" and substituting "a State Service officer or State Service employee";(e) by omitting from subregulation (6)(c) "Commissioner of Public Employment" and substituting "State Service Commissioner".
1. Regulation 44(1)(c) is amended by omitting " Tasmanian State Service Act 1984 " and substituting " State Service Act 2000 ".
