Traffic Amendment (Authorised Officers) Act 2004

An Act to amend the Traffic Act 1925

[Royal Assent 23 September 2004]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Traffic Amendment (Authorised Officers) Act 2004 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Principal Act

In this Act, the Traffic Act 1925 is referred to as the Principal Act.

4.    Section 3 amended (Interpretation)

Section 3(1) of the Principal Act is amended by omitting the definition of authorised officer .

5.    Section 9 amended (Administration of Act)

Section 9 of the Principal Act is amended by omitting subsection (2) and substituting the following subsections:
(2)  Where, under this Act or the Vehicle and Traffic Act 1999 , any power or right may be exercised by an authorised officer, or any act is authorised or required to be done by or in respect of an authorised officer, that power may be exercised by, and that act may be done by or in respect of –
(a) an officer of the Commission; or
(b) an officer of a local authority; or
(c) another person; or
(d) persons of a specified class –
authorised in writing by the Commission in that behalf.
(2A)  A person referred to in subsection (2)(c) may but need not be a State Service employee.
(2B)  A class of persons referred to in subsection (2)(d) may but need not be a class of State Service employees.
