Road Safety (Alcohol and Drugs) Amendment Act 2009

An Act to amend the Road Safety (Alcohol and Drugs) Act 1970

[Royal Assent 7 December 2009]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Road Safety (Alcohol and Drugs) Amendment Act 2009 .

2.   Commencement

This Act commences on a day to be proclaimed.

3.   Principal Act

In this Act, the Road Safety (Alcohol and Drugs) Act 1970 is referred to as the Principal Act.

4.    Section 6A amended (Driving with prescribed illicit drug in blood)

Section 6A of the Principal Act is amended as follows:
(a) by omitting the penalty from subsection (1) ;
(b) by omitting subsections (3) and (4) .

5.    Section 17 amended (Penalties for drink-driving offences, &c.)

Section 17 of the Principal Act is amended as follows:
(a) by omitting from subsection (1)(b) " section 4 , 6 or 14 (5) " and substituting " section 4 , section 6 , section 6A(1) or section 14(5) ";
(b) by inserting in the first table in subsection (5) after

Section 4 or 14 (5) or failure to comply with a requirement made under section 10 (4) or 10A (1)

6.   Repeal of Act

This Act is repealed on the ninetieth day from the day on which it commences.
