Vehicle and Traffic and Related Legislation (Miscellaneous Amendments) Act 2010
An Act to amend the Vehicle and Traffic Act 1999 and Road Safety (Alcohol and Drugs) Act 1970

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
PART 1 - Preliminary
This Act may be cited as the Vehicle and Traffic and Related Legislation (Miscellaneous Amendments) Act 2010 .
This Act commences on the day on which this Act receives the Royal Assent.
PART 2 - Road Safety (Alcohol and Drugs) Act 1970 Amended
In this Part, the Road Safety (Alcohol and Drugs) Act 1970 is referred to as the Principal Act.
4. Section 2 amended (Interpretation)
Section 2 of the Principal Act is amended as follows:(a) by inserting the following definition after the definition of excessive drink-driving notice in subsection (1) :GVM has the same meaning as in the Vehicle and Traffic Act 1999 ;(b) by omitting from subsection (2A)(c) "gross vehicle mass" and substituting "GVM".
PART 3 - Vehicle and Traffic Act 1999 Amended
In this Part, the Vehicle and Traffic Act 1999 is referred to as the Principal Act.
6. Section 3 amended (Interpretation)
Section 3(1) of the Principal Act is amended as follows:(a) by omitting "vehicle," from the definition of GCM and substituting "vehicle, also known as the gross combination mass for a motor vehicle,";(b) by omitting "vehicle," from the definition of GVM and substituting "vehicle, also known as the gross vehicle mass for a vehicle,";(c) by inserting the following definition after the definition of passenger vehicle :personalised number plate means a number plate issued by the Registrar that (a) contains a specific registration number; or(b) does not meet the specifications of a number plate that is generally issued under this Act on payment of the basic fee prescribed for the issue of number plates;(d) by inserting the following definition after the definition of short term unregistered vehicle permit :specific registration number means a combination of numbers or of letters, or of numbers and letters, that is requested as the registration number to be issued on a number plate;
7. Section 13A amended (Regression of novice drivers and novice riders)
Section 13A(1)(b) of the Principal Act is amended by omitting " section 20 " and substituting " section 24 ".
8. Section 39A inserted
After section 39 of the Principal Act , the following section is inserted in Part 6:39A. Personalised number plates regulations
(1) The regulations may make provision for, and with respect to (a) a request for the rights to a specific registration number; and(b) the issue of personalised number plates that may be attached to a vehicle or held independently of a vehicle.(2) Without limiting the generality of subsection (1) , the regulations may prescribe requirements in relation to one or more of the following:(a) the assigning of rights to a specific registration number;(b) the issue of personalised number plates;(c) the replacement of personalised number plates;(d) the circumstances under which a personalised number plate may be attached to a vehicle or held by an individual;(e) the conditions under which personalised number plates may be used or possessed;(f) the sale, trade or transfer of specific registration numbers and personalised number plates;(g) the return or exchange of personalised number plates;(h) the cancellation or surrender of personalised number plates;(i) the fees payable in respect of the assigning of rights to a specific registration number and the issue, trade, transfer and conversion of personalised number plates;(j) the determining or approving of any fee payable in respect of a specific registration number or personalised number plate.(3) A fee in relation to a personalised number plate may vary according to the particular registration number or class of registration numbers and is not limited to an amount that is related to the cost of providing any service.(4) The regulations may provide for the validation of any prescribed actions taken before the commencement of the Vehicle and Traffic and Related Legislation (Miscellaneous Amendments) Act 2010 .
PART 4 - Repeal of Act
This Act is repealed on the ninetieth day from the day on which this Act commences.
