Traffic Amendment Act 2016

An Act to amend the Traffic Act 1925

[Royal Assent 31 October 2016]

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Traffic Amendment Act 2016 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Principal Act

In this Act, the Traffic Act 1925 is referred to as the Principal Act.

4.    Section 43G amended (Notice of demand)

Section 43G of the Principal Act is amended as follows:
(a) by inserting in subsection (1) "or an authorised officer" after "A police officer";
(b) by omitting from subsection (1) "police" second occurring;
(c) by inserting in subsection (2)(c) ", or an authorised officer" after "officer".

5.    Section 43GB amended (Withdrawal of notice of demand)

Section 43GB of the Principal Act is amended by omitting subsection (2) and substituting the following subsection:
(2)  For the purposes of subsection (1) , a notice of demand is to be withdrawn –
(a) in the case of a notice of demand served on a registered operator by a police officer, by the service on that registered operator of a withdrawal notice in a form approved by the Commissioner of Police and signed by a police officer; and
(b) in the case of a notice of demand served on a registered operator by an authorised officer, by the service on that registered operator of a withdrawal notice in a form approved by the Commissioner of Police and signed by an authorised officer.

6.   Repeal of Act

This Act is repealed on the three hundred and sixty fifth day from the day on which it commences.
