Traffic (Road Rules) Amendment (Public Vehicles Reform) Regulations 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Road Rules) Amendment (Public Vehicles Reform) Regulations 2000 .

2.   Commencement

These regulations take effect immediately after the Passenger Transport Act 1997 commences.

3.   Principal Rules

In these rules, the Traffic (Road Rules) Regulations 1999 are referred to as the Principal Rules.

4.    Rule 352 amended (Direction by police officer or authorised person in connection with offences)

Rule 352(1) of the Principal Rules is amended as follows:
(a) by inserting in paragraph (a) ", the Passenger Transport Act 1997 or the Taxi and Luxury Hire Car Industries Act 1995 " after "Act";
(b) by inserting in paragraph (b) ", the Passenger Transport Act 1997 or the Taxi and Luxury Hire Car Industries Act 1995 " after "committed an offence against the Act".

5.    Rule 378 amended (Speed-limit near school buses)

Rule 378(2) of the Principal Rules is amended by omitting the definitions of school bus warning light and school bus warning sign and substituting the following definitions:
school bus warning light means a warning light fitted to a bus carrying schoolchildren, in accordance with regulation 75H (1) of the Traffic (Miscellaneous) Regulations 1968 ;
school bus warning sign means a warning sign fitted to a bus carrying schoolchildren, in accordance with regulation 75H (1) of the Traffic (Miscellaneous) Regulations 1968 .

6.    Schedule 6 amended (Jurisdictional qualifications)

Schedule 6 to the Principal Rules is amended as follows:
(a) by omitting from clause 2(b) of Part 1 "constructed primarily for the carriage of goods";
(b) by omitting from clause 2(b) of Part 1 "vehicle;" and substituting "vehicle.";
(c) by omitting paragraph (c) from clause 2 of Part 1 ;
(d) by omitting clause 8 from Division 1 of Part 2 and substituting the following clause:
8.   Public bus
(1) A vehicle is a public bus for rule 183 if it is a bus that is –
(a) registered as a public passenger vehicle in accordance with the Passenger Transport Act 1997 ; and
(b) operating on a regular passenger transport service authorised under that Act.
(2) A vehicle is a public bus for the Road Rules if it is –
(a) a bus that is registered as a public passenger vehicle in accordance with the Passenger Transport Act 1997 ; or
(b) a bus that is –
(i) registered in another State or a Territory; and
(ii) permitted under a law of that State or Territory to operate as a public passenger vehicle; and
(iii) operating as a public passenger vehicle in this State under charter.
(e) by omitting from clause 10 of Division 1 of Part 2 " Taxi Industry Act 1995 " and substituting " Taxi and Luxury Hire Car Industries Act 1995 ".
