Wildlife Amendment (Open Season) Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the National Parks and Wildlife Act 1970 .

1.   Short title

These regulations may be cited as the Wildlife Amendment (Open Season) Regulations 2001 .

2.   Commencement

These regulations take effect on 1 January 2002.

3.   Principal Regulations

In these regulations, the Wildlife Regulations 1999 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by omitting the definition of open season from subregulation (1) and substituting the following definition:
open season, in relation to a form of partly protected wildlife, means the season during which the taking of the form of partly protected wildlife is permitted by order under section 35A of the Act;
(b) by omitting subregulation (5) .

5.    Regulation 25 amended (Deer, pheasant and brown quail)

Regulation 25 of the Principal Regulations is amended by omitting subregulation (1) and substituting the following subregulation:
(1)  Except as authorised by a permit, a person must not take more than 2 deer during an open season, that total being made up of –
(a) one adult male deer and one antlerless deer; or
(b) 2 antlerless deer.
Penalty:  Fine not exceeding 50 penalty units.

6.    Schedule 8 rescinded

Schedule 8 to the Principal Regulations is rescinded.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Wildlife Regulations 1999 by –
(a) providing that, unless authorised by a permit, a person must not take more than 2 deer in an open season, that total being made up of –
(i) one adult male deer and one antlerless deer; or
(ii) 2 antlerless deer; and
(b) effecting minor revisions subsequent to the enactment of the National Parks and Wildlife Amendment Act (No. 2) 2001.
