Poisons Amendment (Notifiable Disease) Regulations 2009
I, the Administrator in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment (Notifiable Disease) Regulations 2009 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Poisons Regulations 2008 are referred to as the Principal Regulations.
4. Regulation 62 amended (Minister's authorisation for possession and supply of restricted substances)
Regulation 62 of the Principal Regulations is amended as follows:(a) by omitting from paragraph (f) "exists." and substituting "exists;";(b) by inserting the following paragraph after paragraph (f) :(g) where, in relation to a notifiable disease, the Director of Public Health issues (i) a notice under section 41 or 42 of the Public Health Act 1997 ; or(ii) an order under section 53 of the Public Health Act 1997 .

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Poisons Regulations 2008 by providing that the issuance by the Director of Public Health of a specified notice or order in relation to the control of notifiable diseases constitutes a circumstance in which the Minister for Health may authorise a registered nurse to possess or supply a restricted substance.
