Poisons Amendment Regulations 2009
I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment Regulations 2009 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Poisons Regulations 2008 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3(1) of the Principal Regulations is amended by inserting after the definition of day book the following definition:day-treatment centre means a centre at which a person is admitted and discharged on the same day for medical, surgical or other treatment;
5. Regulation 22 amended (Minister's authorisation for possession and supply of narcotic substance)
Regulation 22 of the Principal Regulations is amended as follows:(a) by omitting from paragraph (c) "practitioner." and substituting "practitioner;";(b) by inserting the following paragraph after paragraph (c) :(d) where the registered nurse is in charge of a day-treatment centre approved by the Secretary and is administering or supplying a narcotic substance in respect of a patient in the centre in accordance with the instructions of a medical practitioner.
6. Regulation 62 amended (Minister's authorisation for possession and supply of restricted substance)
Regulation 62 of the Principal Regulations is amended by inserting after paragraph (c) the following paragraph:(ca) where the registered nurse is in charge of a day-treatment centre approved by the Secretary and is administering or supplying a restricted substance in respect of a patient in the centre in accordance with the instructions of a medical practitioner;
7. Regulation 74 amended (Restrictions on certain dangerous poisons)
Regulation 74 of the Principal Regulations is amended by omitting paragraph (c) and substituting the following paragraph:(c) as authorised under the Dangerous Substances (Safe Handling) Act 2005 or any other relevant Act.
8. Schedule 7 amended (Class 1 substances)
Schedule 7 to the Principal Regulations is amended by inserting after item 19 the following item:19M. Homatropine.

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Poisons Regulations 2008 by (a) providing a new circumstance for which the Minister for Health may authorise a registered nurse to possess or supply a restricted or narcotic substance; and(b) updating regulation 74(c) consequentially on the enactment of the Dangerous Substances (Safe Handling) Act 2005 ; and(c) adding homatropine to the list of prescribed class 1 substances for the purposes of section 38(1) of the Poisons Act 1971 .
