Local Government (Number of Councillors) Order 2013

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Minister, make the following order under section 214E(1)(m) and section 25(4) of the Local Government Act 1993 .

PART 1 - Preliminary

1.   Short title

This order may be cited as the Local Government (Number of Councillors) Order 2013 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if it were by-laws.

(2)  A word or expression used in this order and in the Local Government Act 1993 has the meaning it has in that Act.

PART 2 - Number of Councillors

4.   Number of councillors for Central Coast municipal area

The total number of persons to be elected as councillors of the municipal area of Central Coast is 9 on and after the day on which the certificate of election is issued in respect of the next ordinary election of councillors for that municipal area that is held after this order takes effect.

5.   Number of councillors for Devonport municipal area

The total number of persons to be elected as councillors of the municipal area of Devonport is 9 on and after the day on which the certificate of election is issued in respect of the next ordinary election of councillors for that municipal area that is held after this order takes effect.

6.   Number of councillors for Glamorgan-Spring Bay municipal area

The total number of persons to be elected as councillors of the municipal area of Glamorgan-Spring Bay is 8 on and after the day on which the certificate of election is issued in respect of the next ordinary election of councillors for that municipal area that is held after this order takes effect.

7.   Number of councillors for Glenorchy municipal area

The total number of persons to be elected as councillors of the municipal area of Glenorchy is 10 on and after the day on which the certificate of election is issued in respect of the next ordinary election of councillors for that municipal area that is held after this order takes effect.

8.   Number of councillors for Kingborough municipal area

The total number of persons to be elected as councillors of the municipal area of Kingborough is 10 on and after the day on which the certificate of election is issued in respect of the next ordinary election of councillors for that municipal area that is held after this order takes effect.

9.   Number of councillors for Tasman municipal area

The total number of persons to be elected as councillors of the municipal area of Tasman is 7 on and after the day on which the certificate of election is issued in respect of the next ordinary election of councillors for that municipal area that is held after this order takes effect.

PART 3 - Amendment of Local Government Act 1993

10.   Principal Act

In this order, the Local Government Act 1993 is referred to as the Principal Act.

11.    Schedule 3 amended (Municipal Areas, Councils and Electoral Districts)

Schedule 3 to the Principal Act is amended as follows:

EXPLANATORY NOTE

(This note is not part of the order)

(a) determines the number of persons to be elected as councillors of the following municipal areas:

(i) Central Coast;

(ii) Devonport;

(iii) Glamorgan-Spring Bay;

(iv) Glenorchy;

(v) Kingborough;

(vi) Tasman; and

(b) amends column 3 of Schedule 3 to the Local Government Act 1993 by updating the number of councillors in respect of those municipal areas to give effect to this order.
