HomeBuilder Grants (Amendment of Act) Order 2020
I make the following order under section 19(1) of the HomeBuilder Grants Act 2020 .

PART 1 - Preliminary
This order may be cited as the HomeBuilder Grants (Amendment of Act) Order 2020 .
(1) Except as provided in this clause, the provisions of this order are taken to have taken effect on 9 December 2020.(2) Part 3 is taken to have taken effect on 4 June 2020.(3) Part 4 is taken to have taken effect on 29 November 2020.
This order is revoked on the first anniversary of the day on which the last uncommenced provision of this order commenced.
PART 2 - HomeBuilder Grants Act 2020 Amended
In this Part, the HomeBuilder Grants Act 2020 is referred to as the Principal Act.
5. Section 13 amended (Eligible transaction for Tasmanian HomeBuilder grant)
Section 13(1)(a)(i) of the Principal Act is amended by omitting "1 January 2021" and substituting "1 April 2021".
6. Section 15 amended (Amount of Commonwealth HomeBuilder grant)
Section 15(1) of the Principal Act is amended as follows:(a) by omitting "is $25 000." and substituting "is –";(b) by inserting the following paragraphs at the foot of subsection (1) :(a) for an eligible transaction entered into before 1 January 2021, $25 000; or(b) for an eligible transaction entered into on or after 1 January 2021 but before 1 April 2021, $15 000.
7. Section 18 amended (Eligible transaction for Commonwealth HomeBuilder grant)
Section 18(2) of the Principal Act is amended as follows:(a) by omitting from paragraph (a) "1 January 2021" and substituting "1 April 2021";(b) by omitting from paragraph (b) "1 January 2021" and substituting "1 April 2021".
8. Section 20 amended (Application for grant)
Section 20(2)(c)(ii) of the Principal Act is amended by omitting "1 January 2021" and substituting "15 April 2021".
PART 3 - HomeBuilder Grants Act 2020 Further Amended
In this Part, the HomeBuilder Grants Act 2020 is referred to as the Principal Act.
10. Section 13 amended (Eligible transaction for Tasmanian HomeBuilder grant)
Section 13(1)(d) of the Principal Act is amended as follows:(a) by omitting "than –" and substituting "than 6 months after the day on which the contract is made; and";(b) by omitting subparagraphs (i) and (ii) .
11. Section 18 amended (Eligible transaction for Commonwealth HomeBuilder grant)
Section 18(1)(c) of the Principal Act is amended as follows:(a) by omitting "than –" and substituting "than 6 months after the day on which the contract is made.";(b) by omitting subparagraphs (i) and (ii) .
PART 4 - HomeBuilder Grants Act 2020 Further Further Amended
In this Part, the HomeBuilder Grants Act 2020 is referred to as the Principal Act.
13. Section 13 amended (Eligible transaction for Tasmanian HomeBuilder grant)
Section 13(1)(c) of the Principal Act is amended by omitting subparagraph (ii) and substituting the following subparagraph:(ii) held such a licence on –(A) if the relevant contract was entered into before 29 November 2020, 4 June 2020; or(B) if the relevant contract was entered into on or after 29 November 2020 but before 1 April 2021, 29 November 2020; and
14. Section 18 amended (Eligible transaction for Commonwealth HomeBuilder grant)
Section 18(1)(b) of the Principal Act is amended by omitting subparagraph (ii) and substituting the following subparagraph:(ii) held such a licence on –(A) if the relevant contract was entered into before 29 November 2020, 4 June 2020; or(B) if the relevant contract was entered into on or after 29 November 2020 but before 1 April 2021, 29 November 2020; and
Displayed and numbered in accordance with the Rules Publication Act 1953.

EXPLANATORY NOTE
(This note is not part of the order)
This order amends the HomeBuilder Grants Act 2020 , to ensure that that Act is consistent with the National Partnership, by –(a) extending the application of both HomeBuilder schemes under that Act until 31 March 2021; and(b) reducing the Commonwealth HomeBuilder grant from 1 January 2021 to $15 000; and(c) extending the period during which relevant construction is required to commence under the Act; and(d) making other minor legislative changes to reflect the extension of the schemes.
