Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment Regulations (No. 3) 2021

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment Regulations (No. 3) 2021 .

2.   Commencement

These regulations take effect on 1 September 2021.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021 are referred to as the Principal Regulations.

4.    Regulation 163 amended (Fees generally)

Regulation 163 of the Principal Regulations is amended by inserting after subregulation (4) the following subregulation:

(4A)  If a registration period is to be more or less than a period for which an applicable scheduled fee, that is a registration fee, is fixed in Schedule 1 , the fire levy component of that fee payable on registration or renewal of registration of a motor vehicle (other than a motor cycle) is to be calculated in accordance with the following formula:

where –

A is the fire levy component payable for the period for which the vehicle is to be registered;

B is the rounded indexed amount (as defined in section 77L of the Fire Service Act 1979 for the relevant financial year;

C is the number of days in the period for which the vehicle is to be registered;

D is the number of days in the 12-month period that commences on the day on which the registration, or renewal of registration, to which the fire levy component relates, is to take effect.

5.    Schedule 1 amended (Fees)

Schedule 1 to the Principal Regulations is amended by omitting item 6 in Part 3 and substituting the following item:

(a) for seasonal registration, or renewal of seasonal registration, of a heavy vehicle

(b) for registration, or renewal of registration, of a heavy vehicle for a period of 3 months

(c) for registration, or renewal of registration, of a heavy vehicle for a period of 6 months

(d) for registration, or renewal of registration, of a light vehicle for a period of 3 months –

(i) in the case of a pensioner, an eligible asylum seeker, a person with a severe disability, or the parent or guardian of a person who has a severe disability and has not attained the age of 16 years

(ii) in the case of any other person

(e) for registration, or renewal of registration, of a light vehicle for a period of 6 months –

(i) in the case of a pensioner, an eligible asylum seeker, a person with a severe disability, or the parent or guardian of a person who has a severe disability and has not attained the age of 16 years

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021 by specifying –

(a) the method of calculating the fire levy component of certain motor vehicle registration payments if a registration period is other than 12 months; and

(b) the administrative fee payable in relation to certain motor vehicle registration payments if a registration period is other than 12 months.
