I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Personal Mobility Devices) Regulations 2021 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021 are referred to as the Principal Regulations.

4.    Regulation 144 amended (Exclusion of air cushion vehicles and personal mobility devices from definition of motor vehicle)

Regulation 144 of the Principal Regulations is amended as follows:
(a) by omitting "vehicle." from the definition of air cushion vehicle in subregulation (1) and substituting "vehicle;";
(b) by inserting the following definition after the definition of air cushion vehicle in subregulation (1) :
personal mobility device has the same meaning as in the Road Rules.
(c) by omitting subregulation (2) and substituting the following subregulation:
(2)  The following classes of vehicles are excluded from the ambit of the definition of motor vehicle under paragraph (g) of that definition in section 3 of the Act:
(a) air cushion vehicles;
(b) personal mobility devices.

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021 so that personal mobility devices do not fall within the definition of motor vehicle in section 3 of the Vehicle and Traffic Act 1999.
