Burial and Cremation Amendment Regulations 2024

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Burial and Cremation Act 2019 .

1.   Short title

These regulations may be cited as the Burial and Cremation Amendment Regulations 2024 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Burial and Cremation Regulations 2015 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended by inserting after the definition of Act the following definition:
alkaline hydrolysis means a process in which human remains –
(a) are placed in a solution of water and alkali in a pressurised chamber; and
(b) are heated, in that chamber, to a temperature that causes the human remains to be reduced to a sterile liquid and bones;

5.    Part 4, Division 1AA inserted

After Part 4 of the Principal Regulations , the following Division is inserted in Part 4:
Division 1AA - Preliminary

48AA.   Prescribed means of cremation

For the purposes of the definition of cremation in section 3(1) of the Act, alkaline hydrolysis is a prescribed means.

These regulations amend the Burial and Cremation Regulations 2015 by adding alkaline hydrolysis as a prescribed means of cremation.
